Art. 157.

§ 1. Właściwy do stwierdzenia nieważności decyzji w przypadkach wymienionych w art. 156 jest organ wyższego stopnia, a gdy decyzja wydana została przez ministra lub samorządowe kolegium odwoławcze – ten organ.

§ 2. Postępowanie w sprawie stwierdzenia nieważności decyzji wszczyna się na żądanie strony lub z urzędu.
