Art. 770.

§ 1. Komisant nie ponosi odpowiedzialności za ukryte wady fizyczne rzeczy, jak również za jej wady prawne, jeżeli przed zawarciem umowy podał to do wiadomości kupującego. Jednakże wyłączenie odpowiedzialności nie dotyczy wad rzeczy, o których komisant wiedział lub z łatwością mógł się dowiedzieć.

§ 2. Przepisu § 1 nie stosuje się, jeżeli kupującym jest konsument.
