Art. 599.

§ 1. Jeżeli zobowiązany z tytułu prawa pierwokupu sprzedał rzecz osobie trzeciej bezwarunkowo albo jeżeli nie zawiadomił uprawnionego o sprzedaży lub podał mu do wiadomości istotne postanowienia umowy sprzedaży niezgodnie z rzeczywistością, ponosi on odpowiedzialność za wynikłą stąd szkodę.

§ 2. Jednakże jeżeli prawo pierwokupu przysługuje z mocy ustawy Skarbowi Państwa lub jednostce samorządu terytorialnego, współwłaścicielowi albo dzierżawcy, sprzedaż dokonana bezwarunkowo jest nieważna.
