Art. 538. Jeżeli w miejscu i czasie zawarcia umowy sprzedaży obowiązuje zarządzenie, według którego za rzeczy danego rodzaju lub gatunku nie może być zapłacona cena wyższa od ceny określonej (cena maksymalna), kupujący nie jest obowiązany do zapłaty ceny wyższej, a sprzedawca, który otrzymał cenę wyższą, obowiązany jest zwrócić kupującemu pobraną różnicę.
