Art. 459.

§ 1. Zobowiązany do wydania zbioru rzeczy lub masy majątkowej albo do udzielenia wiadomości o zbiorze rzeczy lub o masie majątkowej powinien przedstawić wierzycielowi spis rzeczy należących do zbioru lub spis przedmiotów wchodzących w skład masy majątkowej.

§ 2. Jeżeli istnieje uzasadnione przypuszczenie, że przedstawiony spis nie jest rzetelny lub dokładny, wierzyciel może żądać, ażeby dłużnik złożył zapewnienie przed sądem, iż sporządził spis według swojej najlepszej wiedzy.
