Art. 452. Jeżeli świadczenie zostało spełnione do rąk osoby nieuprawnionej do jego przyjęcia, a przyjęcie świadczenia nie zostało potwierdzone przez wierzyciela, dłużnik jest zwolniony w takim zakresie, w jakim wierzyciel ze świadczenia skorzystał. Przepis ten stosuje się odpowiednio w wypadku, gdy świadczenie zostało spełnione do rąk wierzyciela, który był niezdolny do jego przyjęcia.
