§ 1. Zobowiązany do wydania korzyści może żądać zwrotu nakładów koniecznych o tyle, o ile nie znalazły pokrycia w użytku, który z nich osiągnął. Zwrotu innych nakładów może żądać o tyle, o ile zwiększają wartość korzyści w chwili jej wydania; może jednak zabrać te nakłady, przywracając stan poprzedni.
