Art. 379.

§ 1. Jeżeli jest kilku dłużników albo kilku wierzycieli, a świadczenie jest podzielne, zarówno dług, jak i wierzytelność dzielą się na tyle niezależnych od siebie części, ilu jest dłużników albo wierzycieli. Części te są równe, jeżeli z okoliczności nie wynika nic innego.

§ 2. Świadczenie jest podzielne, jeżeli może być spełnione częściowo bez istotnej zmiany przedmiotu lub wartości.
