§ 1. Jeżeli jeden z dłużników solidarnych spełnił świadczenie, treść istniejącego między współdłużnikami stosunku prawnego rozstrzyga o tym, czy i w jakich częściach może on żądać zwrotu od współdłużników. Jeżeli z treści tego stosunku nie wynika nic innego, dłużnik, który świadczenie spełnił, może żądać zwrotu w częściach równych.

§ 2. Część przypadająca na dłużnika niewypłacalnego rozkłada się między współdłużników.
