Art. 375.

§ 1. Dłużnik solidarny może się bronić zarzutami, które przysługują mu osobiście względem wierzyciela, jak również tymi, które ze względu na sposób powstania lub treść zobowiązania są wspólne wszystkim dłużnikom.

§ 2. Wyrok zapadły na korzyść jednego z dłużników solidarnych zwalnia współdłużników, jeżeli uwzględnia zarzuty, które są im wszystkim wspólne.
