Art. 3571.

Jeżeli z powodu nadzwyczajnej zmiany stosunków spełnienie świadczenia byłoby połączone z nadmiernymi trudnościami albo groziłoby jednej ze stron rażącą stratą, czego strony nie przewidywały przy zawarciu umowy, sąd może po rozważeniu interesów stron, zgodnie z zasadami współżycia społecznego, oznaczyć sposób wykonania zobowiązania, wysokość świadczenia lub nawet orzec o rozwiązaniu umowy. Rozwiązując umowę sąd może w miarę potrzeby orzec o rozliczeniach stron, kierując się zasadami określonymi w zdaniu poprzedzającym.
