Art. 347.

§ 1. Posiadaczowi nieruchomości przysługuje roszczenie o wstrzymanie budowy, jeżeli budowa mogłaby naruszyć jego posiadanie albo grozić wyrządzeniem mu szkody.

§ 2. Roszczenie może być dochodzone przed rozpoczęciem budowy; wygasa ono, jeżeli nie będzie dochodzone w ciągu miesiąca od rozpoczęcia budowy.
