Art. 10381. W przypadku gdy w skład spadku wchodzi przedsiębiorstwo, dział spadku obejmuje to przedsiębiorstwo z uwzględnieniem potrzeby zapewnienia kontynuacji prowadzonej przy jego wykorzystaniu działalności gospodarczej, chyba że spadkobiercy oraz małżonek spadkodawcy, któremu przysługuje udział w przedsiębiorstwie, nie osiągnęli porozumienia co do kontynuacji tej działalności.
