Art. 1036. Spadkobierca może za zgodą pozostałych spadkobierców rozporządzić udziałem w przedmiocie należącym do spadku. W braku zgody któregokolwiek z pozostałych spadkobierców rozporządzenie jest bezskuteczne o tyle, o ile naruszałoby uprawnienia przysługujące temu spadkobiercy na podstawie przepisów o dziale spadku.
