Art. 1017. Jeżeli przed upływem terminu do złożenia oświadczenia o przyjęciu lub o odrzuceniu spadku spadkobierca zmarł nie złożywszy takiego oświadczenia, oświadczenie o przyjęciu lub o odrzuceniu spadku może być złożone przez jego spadkobierców. Termin do złożenia tego oświadczenia nie może się skończyć wcześniej aniżeli termin do złożenia oświadczenia co do spadku po zmarłym spadkobiercy.
