§ 1. Jeżeli uprawniony nie może otrzymać należnego mu zachowku od spadkobiercy lub osoby, na której rzecz został uczyniony zapis windykacyjny, może on żądać od osoby, która otrzymała od spadkodawcy darowiznę doliczoną do spadku, sumy pieniężnej potrzebnej do uzupełnienia zachowku. Jednakże obdarowany jest obowiązany do zapłaty powyższej sumy tylko w granicach wzbogacenia będącego skutkiem darowizny.
